NOTICE OF STATE ENVIRONMENTAL POLICY ACT (SEPA)

ENVIRONMENTAL REVIEW

NOTICE IS HEREBY GIVEN that the City of Dayton has received a SEPA Environmental Checklist and other environmental reports and studies from the US Fish and Wildlife Service (USFWS) including an Environmental Action Statement (NEPA Categorical Exclusion) relating to a proposed project to repair a weir on the Touchet River at the Dayton Pond Intake Facility.  The USFWS intends to repair the current weir and install a new Obermeyer Weir on the Touchet River, within a parcel owned by the City of Dayton (Columbia County Parcel #264771). The current weir has experienced erosion during high flows and is now undermined, causing concerns for stability of the structure and safety concerns for the public. The proposed work will stabilize the existing structure and riverbed both upstream and downstream. The installation of the new Obermeyer Weir will maintain the river channel.

The proposal site is located in the Touchet River (Hydrologic Unit Code 170701020308) east of the terminus of S Cottonwood St. in Dayton, west of the USACE levee, and situated in Section 30, Township 10 N, Range 39 E, W.M.  Geo ID: 1160200350000. Full legal descriptions are on-file with the City of Dayton and available upon request; the parcels are within Rainwater and Mustard, Tax 35 (Rock Hill).  The weir is located on Columbia County parcel no. 264771. Other potentially affected parcels are nos. 264569, 264768, 264773, and 275544.  There is no address assigned.

NOTICE IS FURTHER GIVEN that the proposal is subject to environmental review.  The City of Dayton is the lead agency for the proposal under the State Environmental Policy Act (SEPA) and reviewed the proposal for probable adverse environmental impacts and issued a determination of non-significance (DNS) for this proposal on February 9, 2023.  Through the DNS process the City has also adopted existing documents:  a NEPA Categorical Exclusion document, Prepared January 11, 2023 by the USFWS.  Documents are available on the City’s website at https://daytonwa.com/inside-city-hall/departments/city-clerk/public-notices  

The Comment period for the DNS concludes at 5:00 pm on February 23, 2023.  The environmental checklist, adopted documents, and related file information is available to the public upon request and will be sent to agencies with jurisdiction, the Washington State Department of Ecology, and others having an interest in the proposal.

NOTE:  The issuance of the Determination of Non-Significance (DNS) does not constitute project approval. The applicant must comply with all other applicable requirements of the City of Dayton and other agencies with jurisdiction prior to receiving construction permits.  A Shoreline Conditional Use permit must be obtained, and future notice of any such application shall be given in accordance with Dayton Municipal Code Title 10 and the City's Shoreline Master Program.

NOTICE IS HEREBY GIVEN that the Dayton City Council has scheduled an open record public hearing for Tuesday, November 22, 2022 at 6:00 P.M. to receive comments on the Jasper Pines Annexation request. The meeting will be held at City Hall, 111 S. 1st Street, Dayton, WA. A copy of the staff report will be available at least five days prior to the hearing.

DESCRIPTION OF PROPOSAL: The City of Dayton received an Annexation Petition for a 0.68-acre parcel accessed from S. 5th Street within the City’s Urban Growth Area (UGA). The current zoning designation is “UGA,” and the parcel is designated as Urban Density Residential (UDR) by the City’s Comprehensive Plan Land Use Map; the proposed zoning upon annexation would be “Agricultural Residential.” Annexations processed are Type V - Legislative applications in accordance with Dayton Municipal Code (DMC) 10-01.030. City annexations are not subject to review under the State Environmental Policy Act (SEPA) (RCW 43.21C.222).
