NOTICE OF PUBLIC HEARING

NOTICE IS HEREBY GIVEN that a public hearing will be held on, Tuesday November 7th, 2023 at 6:00 p.m., or soon thereafter, at a Regular Meeting of the City Council of the City of Dayton to review and receive comment on proposed revenue sources including a proposed 1% increase in property taxes as part of the City of Dayton 2024 Preliminary Budget as presented by the Mayor to the Dayton City Council on November 7th, 2023.

Said public hearing shall be held via ZOOM ® and in person the ZOOM meeting information will be available online at http://www.daytonwa.com/ not later than 3:00 p.m., November 3rd, 2023.

Written testimony/comments shall be read into the record at the public hearing and can be submitted to the City of Dayton no later than 3:00 p.m. on Thursday, November 2nd, 2023. Project Description: The City of Dayton is proposing updates to the SMP in coordination with Ecology as part of the Shoreline Management Act (SMA) Periodic Review process. The SMP establishes standards for shoreline development. The state SMA requires each jurisdiction with shorelines of the state and shorelines of statewide significance to make and update these rules. The City is proposing to adopt the revised SMP as an update to its 2017 SMP in spring 2023. Proposed amendments to the existing 2017 SMP may be reviewed at https://sewashingtonsmp.com/

Location of proposal: The updated SMP will apply to all waterbodies under SMA jurisdiction within the City, including floodways; land within 200 feet of the ordinary high water mark (OHWM) of the waterways; and associated wetlands. The SMA regulated waterbody in the City is the Touchet River.

Threshold Determination: The lead agency for this proposal has determined that it does not have a probable significant adverse impact on the environment. An environmental impact statement (EIS) is not required under RCW 43.21C.030(2)(c). This decision was made after review of a completed environmental checklist and other information on file with the lead agency. Dayton Pond Intake Facility Weir Repair - Shoreline Conditional Use Permit and Shoreline Substantial Development Permit

NOTICE IS HEREBY GIVEN that the City of Dayton received an application for a combined Shoreline Conditional Use Permit and Shoreline Substantial Development Permit to allow the Dayton Pond Intake Facility Weir Repair project. The application was submitted by Ryan Eldridge, P.E. (WCE Inc), 3813 W. State Street, Boise, Idaho 83703, on behalf of the US Fish and Wildlife Service.  The city determined the application was complete as of March 9, 2023.

Proposal Description: Repair the current weir and install a new Obermeyer Weir on the Touchet River, within a parcel owned by the City of Dayton (Columbia County Parcel no. 264771). The current weir has experienced erosion during high flows and is now undermined, causing concerns for stability of the structure and safety concerns for the public. The proposed work will stabilize the existing structure and riverbed both upstream and downstream. The installation of the new Obermeyer Weir will maintain the river channel.

Proposal Location: No address; the proposal site is located in the Touchet River (Hydrologic Unit Code 170701020308) east of the terminus of S Cottonwood St. in Dayton, west of the USACE levee, and situated in Section 30, Township 10 N, Range 39 E, W.M.  Geo ID: 1160200350000. Full legal descriptions are on-file with the City of Dayton and available upon request; the parcels are within Rainwater and Mustard, Tax 35 (Rock Hill).  The weir is located on Columbia County parcel no. 264771. Other potentially affected parcels are nos. 264569, 264768, 264773, 275544. 

NOTICE IS FURTHER GIVEN that the City’s Hearing Examiner will conduct an OPEN RECORD PUBLIC HEARING on the matter which will take place on Thursday, April 20, 2023, at 10:00 A.M. at City Hall, 111 S. 1st Street, Dayton, WA and virtually via Zoom. Contact the City Clerk – Treasurer at the address below for a copy of the staff report, available five days prior to the hearing.  In accordance with DMC 19-04.060, the Hearing Examiner will submit their written report no later than 14 days following conclusion of the hearing; the Hearing Examiner may recommend that the Shoreline Conditional Use Permit be approved, conditionally approved pending changes or additions, or disapproved. After the Hearing Examiner has approved the permits, the City will file the permit with the Department of Ecology for Ecology’s approval, approval with conditions, or denial.
